CUSTOMER RESPONSIBILITY AND UNIT PREPARATION
The customer is responsible for ensuring that the trailer, vehicle, boat, RV, or other unit is in safe and proper condition for over-the-road transportation. The unit must be properly prepared, and all items, accessories, and components must be securely fastened before transportation begins. Any removable, loose, or exposed items must be removed or properly secured by the customer.
DRIVER INSPECTION
The driver performs only an external visual inspection of the unit before transportation. This inspection does not constitute a mechanical, structural, electrical, or internal inspection. Neither the driver nor the Carrier certifies or guarantees the mechanical, structural, electrical, or internal condition of the unit.
LIMITATION OF CARRIER LIABILITY
The Carrier shall not be responsible for loose, unsecured, or improperly prepared items; moving parts; flammable materials; components that become detached during transportation; damage caused by road wind or normal road conditions; hidden or pre-existing structural damage; wet walls, water intrusion, deterioration, or other conditions that may cause any portion of the unit to detach; or damage that could not reasonably be identified during an external visual inspection. Minor scratches, marks, dents, or abrasions may be considered normal wear and tear associated with transportation.
TIRES, WHEELS, AND ROADSIDE ASSISTANCE
The Carrier shall not be responsible for damage caused by defective, worn, damaged, or poor-condition tires, wheels, valves, or related components, nor for the consequences of a tire blowout or failure during transportation. If the unit does not have a suitable spare tire or requires repairs during transportation, the customer shall be responsible for roadside assistance, repairs, replacement tires, and other expenses necessary to continue transportation.
PICKUP AND DELIVERY CONDITIONS
The customer guarantees that the unit is ready for transportation and has adequate power, battery capacity, or other means necessary to operate lifting mechanisms, stabilizers, landing gear, or other systems required to connect, pick up, or deliver the unit.
The customer authorizes the driver to move, connect, disconnect, and park the unit when reasonably necessary to complete pickup or delivery.
Pickup and delivery locations must be safe, accessible, stable, level, and free of obstacles for the Carrier's vehicle and the transported unit.
WAITING TIME / DETENTION
If the unit, pickup location, or delivery location is not ready when the driver arrives, a waiting-time charge of $50 per hour may apply.
If the unit is not in transportable condition and this results in an extended delay, an additional detention charge of $250 per day may apply, together with any applicable repair, roadside assistance, lodging, parking, or other reasonable expenses resulting from the delay.
PAYMENT AND RELEASE OF UNIT
All transportation charges and other amounts due must be paid according to the payment terms established for the load. The transported unit shall serve as security in favor of the Carrier until all transportation charges and other amounts due have been paid in full.
AUTHORIZATION TO MOVE THE UNIT
The owner, customer, or authorized agent authorizes the Carrier and its drivers to drive, move, connect, disconnect, and park the unit when reasonably necessary between loading, unloading, pickup, and delivery points to complete the transportation service.
DELIVERY, INSPECTION, AND DAMAGE CLAIMS
The customer or recipient must inspect the unit at the time of delivery and note on the Bill of Lading any damage believed to have occurred during transportation before signing for delivery.
No damage claims will be accepted after the unit has been inspected, accepted, and the delivery documentation has been signed without notation of damage.
ACCEPTANCE OF TERMS
By tendering the unit for transportation, accepting or authorizing the transportation service, booking or assigning the load, or signing the Bill of Lading, the customer, owner, recipient, and/or broker acknowledge that they have read, understood, and agreed to these Terms and Conditions as part of the transportation agreement.
BROKER RESPONSIBILITY, PAYMENT, AND LOAD COORDINATION
When a load is not COD (Cash on Delivery) and the transportation service is booked, arranged, or assigned through a broker, the broker agrees to pay the Carrier the agreed transportation rate after completion of the transportation service in accordance with the payment terms and timeframes established in the applicable Rate Confirmation (RateCon), regardless of whether the broker has received payment from its customer, unless otherwise agreed in writing by the parties.
If the unit has been picked up and transportation has begun but delivery to the originally designated destination cannot be completed due to a breakdown, damage, mechanical failure of the transported unit, unsafe condition of the unit, or another circumstance outside the Carrier's reasonable control, the transportation service performed up to that point remains payable. The transportation charge may be reasonably recalculated based on the transportation actually performed up to the location where the unit had to be stopped or unloaded, together with any applicable waiting time, detention, roadside assistance, or other additional charges.
The broker and/or customer may not withhold the entire transportation payment solely because the unit could not reach its final destination due to circumstances outside the Carrier's reasonable control. The customer shall be responsible for providing or authorizing a safe, legal, accessible, and appropriate location where a damaged, disabled, or otherwise non-transportable unit may be left. Any additional service required to move, repair, store, recover, or continue transporting the unit shall be separately coordinated and charged as applicable.
The broker is responsible for providing the Carrier with accurate and sufficient pickup and delivery information, including the names and correct contact information of the customer, shipper, and receiver; correct addresses; operating hours; and any other instructions reasonably necessary to coordinate pickup and delivery within the established timeframes.
Any delay caused by incorrect or incomplete information, inability to contact the customer or receiver, lack of access to the location, or failure to properly coordinate pickup or delivery may result in applicable waiting-time, detention, or other additional charges.
By booking, assigning, tendering, or authorizing the load to the Carrier, the broker acknowledges and agrees to these obligations as part of the transportation agreement.
